The Florence School of Regulation – Communications & Media presents a book by Igor Nikolic, Licensing Standard Essential Patents: FRAND and the Internet of Things (Hart Publishing 2021). The book analyses the evolution of the licensing framework for standard essential patents (SEPs) in over two decades of legal, economic and policy debates and licensing disputes. It also assesses the challenges posed by the use of 5G standard in many different industries and devices. 5G, as well as other cellular standards, will feature a prominent role in bringing connectivity to the Internet of Things (IoT).
The policy towards standard-essential patents (SEPs) is changing, both in the EU and the US. In the EU, the European Commission’s IP Action Plan (2020) announced as a priority the need to ensure stable, efficient and fair rules governing the licensing of SEPs. In particular, the Commission plans to consider reforms to clarify and improve the framework governing declaration, licensing and enforcement of SEPs. In that regard, it published a study (2020) examining the introduction of third-party essentiality evaluation for patents declared as standard-essential, and the Commission’s SEP Expert Group Report (2021) examined 79 proposals to reform different aspects of the SEP licensing framework. In 2022 the Commission announced it might present a legislative proposal for a fair and balanced SEP licensing framework. In the US, the new administration appears to be taking a more restrictive stance towards the conduct of SEP owners. The Department of Justice at the end of 2021 published a Draft Policy Statement on remedies for the infringement of SEPs.
The conference will be dedicated to discussing the existing licensing framework for SEPs, the challenges posed by the use of SEPs by different industries and what needs to change to enable more predictable, transparent, and efficient SEP licensing in the IoT.
The conference will take place in one afternoon from 3.00 – 5.30 pm CET. The event will start with the presentation and discussion of the book, and will move on with a roundtable discussion on the recent global developments regarding the SEP licensing framework from the academic, policy and industry perspective.
The format will be hybrid, part residential and part online. The Conference can be accessible to invited people via Zoom link. Conference rooms at the EUI have been equipped with 360° video cameras that improve users’ experience in virtual meetings.
